The Firm was retained by a Developer and its Design Architect to defend a Project Architect’s claims for additional services, copyright infringement and breach of contract on an airport terminal building project on the island of Lana’i, Hawaii, a golf and country club project in Hawaii and two country club projects in southern California. The firm also asserted the Developer’s claim against the Project Architect for breach of contract and negligence in the preparation of construction drawings and specifications. At the same time, the firm advised the Developer and Design Architect regarding the completion of the airport terminal construction documents for bidding purposes, and the completion of construction of one of the country club projects. The firm was instrumental in defeating the Project Architect’s motion for a temporary restraining order seeking to stop construction of the airport terminal building until its claims were resolved. After the hearing, a global settlement was negotiated which was consistent with the Developer’s and the Design architect’s position before the litigation began.
