Robert L. Ferguson, Jr. and Peter J. Basile represented a security company whose employee, while performing his duties at an apartment complex in Northeast District of Columbia, shot and permanently paralyzed Plaintiff. Plaintiff alleged that Defendant was responsible for the intentional acts of its employee and that it was itself negligent in its hiring, training or supervision of the employee. Defendant filed a Motion for Summary Judgment arguing that the intentional tort claims were time barred since they were not filed within the one year statute of limitations. As for the claims of negligent hiring, training or supervision, the attorneys conducted intensive discovery of the participants and eyewitnesses to the claim and gathered substantial evidence concerning the employee’s experience and training with handgun handling procedures. The attorneys were able to demonstrate that Plaintiff’s expert’s opinion relating to the alleged negligent hiring, training and supervision of the employee was merely conclusory and was not supported by any facts. A Summary Judgment was granted in favor of the Defendant. Plaintiff then filed an appeal which was ultimately dismissed.
