The Firm represented American Airlines, Inc. in this Warsaw Convention claim for permanent injuries to plaintiff’s neck, right shoulder, wrist (carpal tunnel syndrome) and thumb (trigger thumb) during a flight from Baltimore-Washington International Airport to Port au Prince, Haiti. Plaintiff claimed to have been struck by a suitcase that fell out of an overhead bin after the passenger cabin had been prepared for takeoff. Plaintiff’s pre-suit settlement demand was $85,000. We immediately deposed the plaintiff, interviewed the flight crew and accumulated plaintiff’s medical records, discovering a significant history of chronic headaches and carpal tunnel syndrome. Within six months of the assignment of the defense, Plaintiff substantially reduced her demand and settled for nuisance value.
