Robert L. Ferguson, Jr. defended a claim made by Plaintiff against a tractor-trailer driver and trucking company for serious personal injuries she claimed she sustained to her neck, low back, left shoulder and left hip. Plaintiff claimed she was injured after her car was struck on the left side by Defendants’ tractor trailer truck. Plaintiff had a prior accident and injury to her cervical spine, from which she claimed she recovered well. Following the accident with defendant, plaintiff had lumbar surgery and further surgery to her cervical spine which her doctors attributed to the accident with defendants’ truck. Mr. Ferguson was able to prove to the jury, through the testimony of numerous medical experts, that Plaintiff’s surgeries were the result of the previous accident and that her complaints at the time of trial were the result of a psychiatric condition, and not any injuries sustained as a result of the accident with Defendants’ truck. Although Plaintiff requested that the jury award her a substantial verdict, the jury returned a verdict for the Plaintiff only in the amount of $2,317.
